General terms and conditions and acceptance of use for the Needs of Provider Registration (CAPIM)

The following are the general terms and coditions and acceptance that regulate the use of the CAPIM's website (the "Service"), which is accessed through the main address URL http://www.capim.com.mx as well as all others that grant access directly to some sections or pages that are part of this site (banners, links, external or institutional).

The use of the Service attributes the condition of the user of the service (the "User") and expresses the acceptance of the General Terms the moment the User access the service. Consequently, the User must carefully read the General Terms in each occasion the Service is used.

The use of the Service is subject to all notifications, terms of use and instructions made known to the User by the CAPIM, as well as those contained within the General Terms of Use of the site, that supplement the provisions in these General Terms as long as they are not opposed.

Compliance is required for both, individuals and legal entities, that use the Service be it regularly or sporadically.

The User, by simply accessing through any banner, link, external or institutional, related with this Service or relevant to the same, accept and is obligated to follow these particular Terms of Use of this Service.

1. OBJECTIVE

The following General Terms regulate the use of the Service by the CAPIM and the use of the Service by the Users. The CAPIM reserves the right to unilaterally modify the required conditions for its use.

The following site is a strategy to provide information and communication that aims at increasing productivity, by establishing a platform that links productive capabilities of providers and the needs of purveyance of the Industry in Mexico.

2. DEFINITIONS

• CAPIM: Cadena de Proveedores de la Industria Manufacturera.
• CANIETI: Cámara Nacional de la Industria Electrónica, de Telecomunicaciones y Tecnologías de la Información.
• Content: Information, data, texts, software, music, audio clips, photographs, graphics, videos, message and other materials.
• Service: All resources including, without limitation, various instruments of communication, search services, personalized content and scheduling by the network of properties which can be accessed through various devices or equipment or technology known or subsequently developed.
• PIC: Proveeduría de Información y Comunicación.
• User: All individual or legal entity registerd in the CAPIM, or that uses its platform, same subject to these terms and conditions.

Additionally, it is informed that these terms of use do not exclude the existance of other provisions or terms of access to the many sections that make up the site http://www.capim.com.mx, respect the country's laws and international treaties applicable to the matter.

3. ACCESS TERMS AND USE OF SERVICE

The User is committed to use the Service in accordance with the current legislation, the moral, the public order and decency. The User agrees not to use the facilities and capabilities of the Service to perform or suggest illegal activities or with intent to attract the other Users to other services different from the one provided here.

The CANIETI is the only that can manage this site through the Northern Regional Directives.

The User understands that the technical process and transmission of the Services, including its Content, can involve: (a) Transmissions by networks and systems of diverse third parties; and (b) changes to adapt to the technical requirements of the networks and connection devices.

4. USE OF SERVICE IS THE SOLE RESPONSIBILITY OF THE USER

The User acknowledges and voluntarily accepts that the use of the Service takes place, if at all, under the User's sole and exclusive responsibility.

5. ACCEPTANCE OF THE TERMS OF USE AND MODIFICATIONS

The Users should read the General Tems of Use of the site. The use, download or access of the site implies the acceptance and acknowledgement of these Terms of Use.

The Users should absolutely accept the terms and conditions of this agreement, in order to register.

The mere use of the site grants the conditions of User and implies acceptance, full and unconditional, of all and each of the general conditions contained herein at the very moment the site is accessed. By accessing, the User will be subject to the existing Terms of Use and any possible changes. If the User uses any service through this site, the User shall be subject to the rules and regulations applicable to such services.

The User agrees that the CANIETI; and its administrators, moderators and institutions providing the service, by the messages posted in this space, have no liability whatsoever on the information of any registered individuals, so they can not be considered moral or legally responsible for the comments and their consequences.

The User agrees to use the Service in accordance with the law, these General Terms, in a correct and diligent fashion.

7. CONDITIONS OF ACCESS

The Service is non-profit and, therefore, completely free.

Access to certain services, such as the downloading of materal, is subject to the User's registration of http://www.capim.com.mx. In these cases, the User is commited to use the access keys (Username and Password) in accordance with the following restrictions:

The Password, chosen by the User, may not oppose morality nad infringe, in any way, intellectual property rights of third parties.

Access Passwords are for exclusive use of the User and correct use of them are the User's sole responsiblity. The CANIETI is not liable for any damages that the User or a third party may incur as a result of other people using the Passwords, with or without the consent or knowledge of the User.

The CANIETI is committed to comply with the obligation of secrecy regarding the Password used by the User.

The Service provided by the CANIETI, will be managed by the network server that Secretariat has elected after proper assessment has been made.

8. TERMS OF USE

The use of the download site http://www.capim.com.mx must adhere to the content within these Terms of Use, to any applicable legal provisions and the requirement of morality and decency generally accepted.

The download site http://www.capim.com.mx reserves the unilateral right to deny access to this site to Users who have violated these Terms of Use.

The CANIETI does not guarantee the availability and continuity of the Service. Whenever reasonably possible, advance notice of any interruption in the operation of the Service will be made. It will also not guarantee the use of the Service to perform any particular activity, nor its infallibility, particularly but no exclusive, that Users can effectively access different pages that make up the Service, or that through the Service is disseminated effectively to third part information, data or content, or actually receive information, data or third party content. The CANIETI is excluded from any liability for damage of any kind that may occur due to the lack of availibility or continuity of the Service to the fraudulent use that Users have attributed to failures in the Service and failures of the Service and, particularly, thoug not exclusively, to failures in the access of various webpages of the Service, as well as failures in the transmission or reception of information, data or content.

The information provided by Users is subject to the portal under its responsibility and is of public type. The CANIETI does not assume any obligation to keep confidential any information or content that you supply, either by subscribing to the Portal or at any time thereafter.

The User agrees that all content, whether announced publicly or privately, is the sole responsibility of the person who originated such Content. This means that the User, not the CANIETI, is entirely responsible for all Content that it uploads, posts, sends via email or otherwise transmits via the Service. The CANIETI does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of the Content. Under no circumstances and in no way will the CANIETI be responsible for any content, including and not limited to errors or omissions of any content, or for any loss or damage of any kind resulting from the use of any content posted, sent by email or otherwise transmitted via the Service. In case of reporting a change, update or modification of the content website http://www.capim.com.mx, the CANIETI will issue that the User has agreement by reading it.

The CANIETI is excluded from any liability for damages of any kind due to the knowledge that might have unauthorized class, conditions, characterstics and circumstances of the use of the Services that Users or due to access and, if any, to the intereception, removal, alteriation, modification or tampering by unauthorized third parties of any kind that Users transmit or receive through the Service.

By using the website, the User authorizes the CANIETI to use and publish the recorded information.

13. VIRUS

The CANIETI is not held responsible for any damage caused by computer virus, whose absence is not guaranteed, and mistakes, deactivated or of destructive nature to the site http://www.capim.com.mx

14. HACKERS

The Users of the site agree that all information is stored within a database and can be accessed by third parties without the consent of the User, the CANIETI, the webmaster, the administrator and the moderators can not be held responsible for any type of hacking attempt that may lead to this information being comprimised.

15. TECHNICAL FAULTS

The CANIETI is exempt from liability of malfunctions of the site or any of its services caused by other circumstances, such as accidents, force majeure or maintenance.

16. DISCLAIMER OF WARRANTIES AND LIABILITY FOR THE USE OF SERVICE

The CANIETI has no obligation and does not control the use of the Service by its Users. 18. DENIAL OF USE OF SERVICE

The CANIETI reserves the right to remove communications made through it, at any time and without any prior notice to the User whom have violated these Terms.

The User agrees not to use libelous, defamatory, insulting, false, offensive, rude, obnoxious or inciting expressions. The User agrees not to use the Service to make apology of crimes, to promote violence of any kind, to insert inappropriate content or establish communication with other Users, in the jurisdiction of the User, that is unlawful.

19. TERM AND TERMINATION

The Service and its contents are indeterminate, however, the CANIETI may suspend, revoke or terminate the registration with the sole obligation to report it with 30 days prior.
